Chapter 7 - This type of personal or business bankruptcy results in most debt being discharged. Not everyone is eligible for this type of bankruptcy. Our bankruptcy attorneys in Hagerstown can determine whether a debtor is eligible to file for Chapter 7 bankruptcy relief.

Chapter 13 - Individuals who do not qualify for a Chapter 7 bankruptcy, may be eligible for a Chapter 13 bankruptcy. This chapter permits the individual to repay some or all of their debt over five years. After the bankruptcy period is over, the remaining debt is discharged.

Chapter 11

Chapter 11 bankruptcies are available for both individuals and businesses.  An  individual who files for Chapter 11 protection may be a person who has a significant amount of business-related debt with significant assets and high income; or, a person who does not qualify to file a Chapter 7 or 13 bankruptcy petition; or, a person who has a business that could be impacted by a Chapter 7 petition filing; or, a person who needs time to reorganize their debt.   

A Chapter 11 petition is complex and costly. Accordingly, most Chapter 11 bankruptcy cases are filed by business entities. However, individuals are not precluded from seeking Chapter 11 bankruptcy protection.
